NEATCELL DEVICE: COMPREHENSIVE USER AGREEMENT

BINDING LEGAL NOTICE – READ BEFORE PURCHASE OR USE

This document constitutes a legally binding agreement between you (the “User”) and the provider of this cosmetic device (the “Company”). By purchasing or using this device, you expressly acknowledge and agree to ALL terms contained herein, without exception.

MANDATORY ACKNOWLEDGMENTS

1. Product Purpose: User acknowledges this device is sold EXCLUSIVELY for cosmetic purposes. Any marketing materials, testimonials, or product descriptions are for illustrative purposes only and do not constitute guarantees, promises, or representations regarding specific outcomes.

2. No Medical Claims: User explicitly acknowledges that despite any marketing terminology that may suggest otherwise, this product:

   • Is NOT a medical device
   • Is NOT equivalent to professional treatments regardless of any comparative language used
   • Makes NO claims to remove, eliminate, or erase any skin condition completely

3. Results Disclaimer: User acknowledges that all before/after images, testimonials, and result descriptions represent best-case scenarios that may not be typical or achievable for all users. Many factors beyond the Company’s control determine individual results, including but not limited to: skin type, condition severity, proper usage, and individual biology.

COMPREHENSIVE WAIVER OF LIABILITY

User hereby IRREVOCABLY WAIVES ALL RIGHTS to pursue any claims, demands, or legal actions against the Company, its affiliates, distributors, officers, employees, or representatives for:

1. Any dissatisfaction with results obtained
2. Any adverse reactions or side effects, whether listed in documentation or not
3. Any physical, emotional, or financial consequences arising from product use
4. Any expectations based on marketing materials, product descriptions, or verbal representations not explicitly included in this agreement

INDEMNIFICATION OBLIGATION

User agrees to DEFEND, INDEMNIFY, and HOLD HARMLESS the Company from and against any claims, damages, costs, and expenses, including attorneys’ fees, arising from or related to User’s use of the product or violation of this agreement.

CONTRAINDICATION ACKNOWLEDGMENT

By purchasing, User certifies they have thoroughly reviewed all contraindications and will not use the device if any apply. User assumes FULL RESPONSIBILITY for determining their suitability for product use.

ASSUMPTION OF RISK & EDUCATION DUTY

User VOLUNTARILY ASSUMES ALL RISKS associated with device use and acknowledges their responsibility to educate themselves fully about proper usage, potential side effects, and appropriate expectations. The Company has fulfilled its duty to warn through this agreement.

SEVERABILITY & GOVERNING LAW

If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full effect. This agreement shall be governed by applicable state law, with disputes subject to binding arbitration in United States.

BY PURCHASING OR USING THIS PRODUCT, YOU CONFIRM YOU HAVE READ, UNDERSTOOD, AND AGREED TO ALL TERMS HEREIN.
